Court Issues Permanent Injunction Enjoining New Department of Labor Interpretation of “Persuader Rule”

On November 16, 2016, the U.S. District Court for the Northern District of Texas entered a permanent injunction with nationwide effect, preventing the Department of Labor’s new interpretation of the Labor Management Reporting Disclosure Act of 1959 (LMRDA) “Persuader Rule” from being implemented. The Court had previously issued a preliminary injunction blocking enforcement of the rule, which is currently on appeal to the Fifth Circuit Court of Appeals.
